• You have the legal capacity to enter into a binding contract
• You are not prohibited by any applicable law from purchasing, receiving, or consuming alcoholic beverages
• All information you provide to us is accurate, current, and complete

NICOTAWINES reserves the right to verify age and identity at any time and to refuse service where eligibility cannot be confirmed.

All products listed on our website are subject to availability. We reserve the right to discontinue any product at any time without notice.

Prices are displayed in Nigerian Naira (NGN) and are inclusive of applicable taxes unless otherwise stated. Prices are subject to change without prior notice. The price applicable to your order is the price displayed at the time of checkout.

Product images are for illustrative purposes only. The actual product, including vintage, label design, or packaging, may differ slightly from that shown.

Placing an order constitutes an offer to purchase the selected products at the stated price. We reserve the right to accept or decline any order at our discretion.

Order confirmation does not constitute acceptance. A binding contract is formed when we dispatch your order and send a dispatch confirmation.

Payment must be made in full at the time of ordering. We accept payment via bank transfer, card payment, and other methods displayed at checkout. All transactions are processed securely through our payment partners.

In the event of a pricing error, we will notify you and offer the option to proceed at the correct price or cancel your order with a full refund.

We deliver to addresses within Nigeria. Delivery timelines are estimates and may vary based on location, carrier availability, and circumstances beyond our control.

Risk of loss and title to products pass to you upon delivery to the address provided. You are responsible for ensuring someone of legal drinking age is available to receive the delivery.

We are not liable for delays caused by third-party logistics providers, customs procedures, weather events, or other circumstances beyond our reasonable control.

If delivery fails due to an incorrect address provided by you, or because no authorised person was available to receive the order, additional delivery charges may apply for re-delivery.

Due to the nature of alcohol products, we generally do not accept returns once goods have been delivered and accepted. Exceptions apply where:

• Products are delivered damaged or defective
• You received incorrect items
• Products are corked or otherwise unfit for consumption upon first opening

Claims for damaged, defective, or incorrect products must be made within 48 hours of delivery with photographic evidence. Where a valid claim is accepted, we will offer a replacement or refund at our discretion.

Refunds, where applicable, will be processed within 7-14 business days to the original payment method.

Wine Club membership is subject to separate terms communicated at registration. Membership benefits, pricing, and allocation schedules are at NICOTAWINES' discretion and may be modified with reasonable notice.

Membership is personal and non-transferable. NICOTAWINES reserves the right to suspend or terminate membership where these Terms or Wine Club rules are breached.

All content on the NICOTAWINES website, including but not limited to text, images, logos, product descriptions, graphics, and software, is the intellectual property of NICOTAWINES Limited or its licensors and is protected by Nigerian and international intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our prior written consent. You may not use our brand name, logos, or trademarks in any manner that suggests endorsement or affiliation without our express written permission.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorised access or suspected security breach.

We reserve the right to suspend or terminate accounts where there is evidence of fraudulent activity, breach of these Terms, or conduct that is harmful to other users or to NICOTAWINES.

When using our website and services, you agree not to:

• Purchase products on behalf of a minor or provide alcohol to anyone under the legal drinking age
• Use our services for any unlawful purpose or in violation of any applicable regulation
• Attempt to gain unauthorised access to our systems, data, or accounts
• Submit false, misleading, or fraudulent information
• Engage in any activity that disrupts or interferes with the functionality of our website or services
• Resell our products for commercial gain without our prior written authorisation
• Post or transmit harmful, defamatory, or offensive content through our platforms

To the fullest extent permitted by law, NICOTAWINES shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, or services, including but not limited to loss of profits, data, or goodwill.

Our total liability to you for any claim arising from these Terms or your use of our services shall not exceed the total amount paid by you for the specific order giving rise to the claim.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded by law.

You agree to indemnify, defend, and hold harmless NICOTAWINES Limited and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms, your use of our services, or your violation of any applicable law or third-party right.

Our website may contain links to third-party websites or services. These links are provided for your convenience only. We do not endorse or have any control over the content, privacy practices, or terms of third-party sites and are not responsible for any loss or damage arising from your use of them.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Lagos State, Nigeria.
